Paternity Action

A Paternity Action is how rights and obligations are established for children born out of wedlock.  While filed as a paternity action, once paternity has been established the same criteria for establishing child support and time-sharing in the dissolution of the marriage process is used.

There are some unique aspects of this action that make it very important to have someone experienced in these cases help you, including whether the father has effectively established his paternity of the child.  If he has not, while he may be obligated to pay support, he does not have any legal rights to the child.  In fact, just being on the birth certificate does not mean you are legally the father entitled to rights.
